These Terms of Use (the “Terms”) govern your access to and use of the website located at https://votejenlunsford.com and any other websites and online services operated by Friends of Jen Lunsford that link to these Terms (collectively, the “Site”). By accessing or using the Site, you agree to these Terms. If you do not agree to these Terms, please do not use the Site.
About This Site
The Site is operated by Friends of Jen Lunsford, the authorized campaign committee for the re-election of Jen Lunsford to the New York State Assembly in the 135th District. The Site is provided for informational and political purposes. It is not a government website, and it is not affiliated with, endorsed by, or operated by the New York State Assembly or any other government body.
Permission to Use the Site
We grant you a limited, personal, non-exclusive, non-transferable and revocable permission to access and use the Site for your own non-commercial, informational use, and to share and reproduce our content for non-commercial political and educational purposes with attribution to Friends of Jen Lunsford. We may suspend or withdraw this permission at any time.
Intellectual Property
Except where otherwise noted or where content belongs to a third party, the text, graphics, photographs, logos and other material on the Site are owned by or licensed to Friends of Jen Lunsford and are protected by copyright, trademark and other laws. Nothing in these Terms transfers ownership of any of that material to you. You may not use our name, logo or campaign marks in a way that suggests we endorse you, your organization, or your candidacy without our prior written permission.
Information You Submit to Us
When you use a form on the Site to sign up for updates or to volunteer, you agree that the information you provide is accurate and that it is your own information, or information you are authorized to provide. How we handle that information is described in our Privacy Policy. We are not obligated to respond to any submission, and we may decline or discontinue any volunteer relationship at our discretion.
If you give us your mobile number and consent to receive text messages, message and data rates may apply and message frequency may vary. You can reply STOP to opt out at any time, or HELP for help.
Donations
Contributions made through the Site are processed by ActBlue, a third-party service, and are subject to ActBlue’s own terms and privacy policy. We do not process or store payment card details ourselves. Contributions are also subject to applicable New York State campaign finance law, including contribution limits and reporting requirements administered by the New York State Board of Elections.
Prohibited Conduct
You agree not to:
- Use the Site in any way that violates any applicable law or regulation;
- Submit false, misleading or fraudulent information, or impersonate any person or organization;
- Attempt to gain unauthorized access to the Site, its servers, or any related systems or networks;
- Interfere with or disrupt the operation of the Site, including by introducing malware or by transmitting automated or excessive requests;
- Harvest or collect information about other users of the Site;
- Use the Site to send unsolicited commercial or political messages.
Third-Party Links, Content and Services
The Site links to and embeds content from third parties, including news outlets, social media platforms and our donation processor. We do not control that content and are not responsible for it, for the practices of those third parties, or for the accuracy of anything they publish. Links to third-party news coverage are provided for reference and do not imply that the outlet endorses Jen Lunsford or this campaign. Your use of any third-party service is governed by that party’s own terms.
No Warranties
The Site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Site will be uninterrupted, secure or error-free, or that any information on the Site is complete or current. Policy positions, endorsements and other content may change over time.
Limitation of Liability
To the fullest extent permitted by law, Friends of Jen Lunsford and its officers, employees, volunteers, agents and vendors will not be liable for any indirect, incidental, special, consequential or punitive damages arising out of or relating to your access to or use of, or inability to use, the Site. Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

Governing Law
These Terms are governed by the laws of the State of New York, without regard to its conflict of law provisions. You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Monroe County, New York.
